SUBSCRIPTION PROGRAM TERMS & SERVICES

Terms and Services Agreement

Effective Date: 10/1/2024

This Terms and Services Agreement ("Agreement") governs the use of the industrial glove subscription program ("Program") offered by ORIGINAL NATIONS LLC ("Company," "we," "us," or "our") under the TSX Gear brand.

By enrolling in the Program, you ("Customer") agree to the following terms and conditions.

  1. Subscription Plans

We offer the following subscription time period plans options for the purchase of industrial gloves:

  • 3-Month Plan: Glove shipments every 30 days for 3 months.
  • 6-Month Plan: Glove shipments every 30 days for 6 months.
  • 12-Month Plan: Glove shipments every 30 days for 12 months.

By choosing a plan, you commit to the duration of the plan and agree to receive and pay for shipments as outlined below.

  1. Pricing and Payment
  • Subscription prices are based on the plan selected and may vary depending on the quantity and type of gloves requested.
  • Payment for each subscription period (3, 6, or 12 months) is charged in full at the start of each billing cycle.
  • 3-Month Plan: Charged every 30 days for 3 months.
  • 6-Month Plan: Charged every 30 days for 6 months.
  • 12-Month Plan: Charged every 30 days for 12 months.
  • Payments can be made will be made by credit card, ACH, Purchase Order or any other methods we offer.
  • A valid payment method must remain on file to pay for all incurred and recurring fees.  We will continue to charge the credit card until the subscription is terminated.  All payments must be received in full before the shipment of the industrial gloves.
  • Taxes and Fees: Applicable taxes and shipping fees may will be added to your total at checkout.
  1. Automatic Renewal

All subscription plans will automatically renew at the end of their term unless canceled by the Customer before the renewal date.

  • 3-Month Plan: Renews every 3 months.
  • 6-Month Plan: Renews every 6 months.
  • 12-Month Plan: Renews every 12 months. 

Customers will be notified of their upcoming renewal 30 days prior to their renewal date. You can cancel or modify your subscription at any time before the renewal.

  1. Cancellation Policy

Customers may cancel their subscription at any time through their account on our website or by contacting customer service. Cancellations will take effect at the end of the active subscription plan. current billing cycle.

  • No Refunds: There are no refunds for partially used subscription plan periods. Customers will continue to receive industrial gloves until the end of the billing periodactive subscription plan for which they have paid.
  1. Shipping and Delivery
  • Gloves will be shipped on a recurring basis according to the subscription plan selected.
  • Customers are responsible for providing accurate shipping information. Any delays or additional shipping charges due to incorrect information provided by the Customer will be the Customer's responsibility.
  • Shipping Costs: Shipping costs are determined based on the shipping address and may vary.
  • We are not responsible for any delays in shipping due to carrier issues or events beyond our control.
  • Shipping charges will be passed through to paid by the customer.
  1. Changes to Subscription

Customers can modify their subscription preferences, including glove type, quantity, and delivery frequency, through their online account or by contacting customer service. Any changes made will take effect during the next billing cycleafter the current active subscription plan.

  1. Damaged or Defective Products

If any gloves are received damaged or defective, Customers must notify us within 3 days of receiving the shipment to be eligible for a replacement. Replacements will be shipped free of charge.

  1. Customer Responsibilities

Customers agree to:

  • Ensure that a valid payment method is on file. information is up-to-date.
  • Provide accurate and complete shipping details.
  • Notify us promptly of any changes to their account or subscription.
  1. Refunds and Returns
  • Refunds: Subscriptions are non-refundable. Customers may cancel their subscription but will not receive a refund for any unused portion of their subscription.
  • Returns: Only defective or damaged products are eligible for returns or exchanges.

  1. Changes to Terms

We reserve the right to modify these Terms and Services at any time. Customers will be notified of any material changes 30 days in advance. Continued use of the subscription service after the effective date of the changes constitutes acceptance of the new terms.

  1. Termination

We reserve the right to terminate or suspend your subscription at any time if we determine you have violated these terms. In the event of termination by us, you will receive a prorated refund for any unused portion of your subscription.

  1. Governing Law

This Agreement is governed by and construed in accordance with the laws of the state of Texas, which our company is headquartered, without regard to its conflict of law principles.
